Negotiation, mediation and arbitration are some of the ways we use to address disputes. The Dispute Resolution Department at Cranko Karp deals with most fields of dispute resolution from High Court litigation to mediation and arbitration before the Arbitration Foundation of South Africa. Furthermore, the firm is in a unique position in that it regularly represents parties in proceedings brought before the Jewish ecclesiastical courts (The Beth Din).

Negotiation is any form of direct or indirect communication whereby parties who have opposing interests discuss the form of any joint action which they might take to manage and ultimately resolve the dispute between them. Negotiation is a preeminent mode of dispute resolution. Each negotiation is unique, differing from one another in terms of subject matter, the number of participants and the process used.
Negotiation can also be applied within the context of other dispute resolution processes, such as mediation and litigation settlement conferences.

Mediation is an excellent way of resolving a dispute. We at Cranko Karp assist our clients with strategic mediation, with the intent of securing a swift and sensible outcome.

Mediation is commonly used if negotiation is unsuccessful and involves direct or indirect communication between the parties involved, with the intent of reaching a mutual agreement. We aim to negotiate realistic outcomes on our clients’ behalf, taking away the stress of litigation, which can become costly.

This process is used to reach a decision that will legally bind the parties and is similar to that of a court proceeding. During the arbitration a third party, who is impartial, decides on a dispute to resolve it.
The relevant parties present their arguments and evidence to an arbitrator, who effectively acts as a judge, and creates a binding determination.

    • The Beth Din is the Jewish authority responsible for making binding decisions on matters relating to marriage, divorce, Jewish status, adoption and conversion. The Beth Din’s other function is to resolve disputes through arbitration and this can include disputes among workers of the synagogues or any other matter that has been presented to the Beth Din. In addition, from time to time a Beth Din will offer guidance on questions arising in respect of Jewish life and custom.
